Export Notice:
All customers and distributors shall comply in all respects with the United States Export Administration Regulations (EAR), as amended, which provide generally that no commodities, software or technology, including any hardware, software, or technology (or direct products thereof) provided under the Agreement, shall be disclosed, resold, transferred, exported or re-exported, directly or indirectly, without first obtaining all prior approvals required from the U.S. Department of Commerce under the EAR, as explained at http://www.bis.doc.gov. Distributor must obtain any required EAR export license prior to the export, re-export, sale, transfer, or use of the 30 Hz NOPTIC System, including but not limited to NOPTIC products classified on the U.S. Commerce Control List under ECCN 6A003.b.4. The 7.5 Hz NOPTIC System is classified as ECCN 6A993 and can be exported without a license. Distributor will not disclose, sell, transfer, export or re-export any hardware, software, or technology (or direct products thereof) provided under the Agreement: (1) for use by prohibited end users identified on the consolidated list of restricted and prohibited parties available at http://export.gov/ecr/eg_main_023148.asp as that list may change from time to time; or (2) for use for restricted end users and end uses, including end users or end uses related to the design, development, manufacture, testing, or use of nuclear power, missiles, and/or chemical and biological weapons, as explained at http://www.access.gpo.gov/bis/ear/pdf/744.pdf or (3) to prohibited destinations including Cuba, Iran, North Korea, Sudan, and Syria, as that list may change from time to time, available at http://www.bis.doc.gov/index.php/forms-documents/doc_view/452-supplement-no-1-to-part-740-country-groups.
Compliance Notice:
All night vision devices in part or whole are strictly regulated by the US Department of State in accordance with the guidelines in the International Traffic in Arms (ITAR) per title 22, Code of Federal Regulations (CFR), Parts 120-130. Therefore, if you are outside the United States, INCLUDING Canada, you must obtain an export license.
